Timothy Gordon on Amoris laetitia and the death penalty: the record holds, two dates slip

On Rules for Retrogrades, Timothy Gordon says Pope Francis entered his Buenos Aires letter in the Acta Apostolicae Sedis as “authentic magisterium”, that Cardinal Kasper pressed for Communion for the remarried in the 1980s, and that the UN pushed abolition in 1983 and 1989. The first holds; the other two are right in substance with a date or body wrong.

In a Rules for Retrogrades episode published on 17 October 2026 (recorded, he says, on 14 October, while Leo XIV was in hospital), Timothy Gordon argued that Pope Leo has kept two of Pope Francis’s positions he considers errors: on Communion for the divorced and remarried, and on the death penalty. Most of the episode is his argument with critics over whether these teachings bind; TradWatch™ rates only the factual points it rests on.

Context

Whether a teaching taught by one or two popes binds the faithful is Mr Gordon’s theological opinion and is not rated here. On Leo XIV’s address to the October Amoris laetitia meeting, see our earlier fact-check.

Statement 1 · Timothy Gordon

Pope Francis had his 2016 letter to the Buenos Aires bishops and their Amoris laetitia guidelines published in the Acta Apostolicae Sedis as “authentic magisterium”.

  1. Verifiable fact

    The record bears this out

Francis’s letter of 5 September 2016 told the Buenos Aires bishops that their guidelines for chapter VIII of Amoris laetitia fully explain it: “No hay otras interpretaciones” (letter). In December 2017 Catholic News Service reported a note by Cardinal Pietro Parolin saying the Pope wanted both texts published in the Acta Apostolicae Sedis, describing them as “authentic magisterium” (CNS). In October 2023 the Dicastery for the Doctrine of the Faith, answering questions from Cardinal Dominik Duka, said the same: the two documents were published “as authentic Magisterium” (Vatican News).

  2. TradWatch analysis

The label is accurate; what it binds is disputed

“Authentic magisterium” is the Holy See’s own term, so Mr Gordon reports it correctly. How much weight it carries is a matter of debate among theologians and canonists, as the CNS report notes; Mr Gordon himself says on the episode that he does not think it binds.

Statement 2 · Timothy Gordon

Cardinal Walter Kasper pressed for Communion for the divorced and civilly remarried in the mid-1980s, under John Paul II.

  1. Verifiable fact

Under John Paul II, but in 1993

Walter Kasper, then a diocesan bishop in Germany, signed a 1993 pastoral letter with other German bishops urging that divorced and civilly remarried Catholics be allowed back to the sacraments (Wikipedia). The Congregation for the Doctrine of the Faith answered in September 1994 that such faithful cannot receive Communion while the situation lasts (CDF letter). John Paul II had set out the alternative Mr Gordon describes, living “in complete continence”, in Familiaris consortio 84 (1981) (text).

  2. TradWatch analysis

The substance holds; the decade is off

Kasper’s push, the Holy See’s refusal and the Familiaris consortio remedy are as he says. The episode’s date for the push is about eight years early.

Statement 3 · Timothy Gordon

The United Nations made two big pushes to end the death penalty, in 1983 and 1989.

  1. Verifiable fact

1989 was the UN; 1983 was the Council of Europe

The Second Optional Protocol to the International Covenant on Civil and Political Rights, aimed at abolishing the death penalty, was adopted by the UN General Assembly in 1989 (Wikipedia). The 1983 instrument was Protocol No. 6 to the European Convention on Human Rights, a Council of Europe treaty, not a UN one (Wikipedia).

  2. TradWatch analysis

The Church gave its own reasons

The episode suggests John Paul II followed a secular trend. His own argument in Evangelium vitae 56 (1995) rests on the purpose of punishment and on improvements in penal systems, which make cases needing execution “very rare, if not practically non-existent” (text). The 2018 revision of Catechism 2267 cites that line of development (CDF letter). The timing alone does not show cause.

Bottom line

Mr Gordon is right about the Acta Apostolicae Sedis: Francis had the Buenos Aires letter and guidelines published as “authentic magisterium”, and the Dicastery repeated it in 2023. Kasper’s push came in 1993, not the mid-1980s, and the 1983 abolition treaty was the Council of Europe’s, not the UN’s.
