Fair Use & Commentary Notice

Last updated

DRAFT — have a media lawyer review before launch.

TradWatch publishes commentary, criticism and news reporting about public statements made by public figures and media outlets. To do that responsibly, we sometimes quote or embed their material. This notice explains how and why.

Our purpose

Our use of others' material is for the purpose of commentary, criticism, news reporting and education. Each excerpt is presented in order to examine what was said and to answer it with sourced analysis. We believe this use is a fair use under Section 107 of the United States Copyright Act, and is covered by comparable exceptions elsewhere (such as fair dealing for criticism, review and the reporting of current events). [Have counsel confirm the jurisdictions that apply to you.]

How we keep our use fair

  • Transformative purpose. Every quotation is accompanied by our own analysis, context and sources. We do not republish material for its own sake.
  • Brief quotations. We quote only as much as is needed to show precisely what was said. Our publishing system limits any single quotation to 75 words and keeps quoted material under 40% of each analysis.
  • No rehosting. We never copy, download or re-upload audio or video. Media is linked, or embedded using the platform's own official player (such as YouTube or Spotify), which remains under the owner's control. Players load only when a reader chooses to play them.
  • Attribution. Every quotation and embed is attributed to its speaker or outlet and links to the original.
  • No market substitute. Our use does not replace the original work; readers who want the full material are directed to the source.

Not affiliated

TradWatch is not affiliated with, endorsed by or sponsored by any outlet, person or organisation whose material is discussed on this site. Views quoted are those of the speaker. Trademarks and names belong to their respective owners.

Concerns

If you own material on this site and believe our use of it is not fair use, please write to us through our contact page or at [legal contact email], identifying the material and the page where it appears. We review every request promptly and in good faith.
